Article 2 Applicability

2.1 El Ramla Hamra reserves the right to change the terms and conditions of its website in the meantime.

2.2 The delivery and payment terms apply to all offers, orders and agreements.

2.3 If you place an order, you agree to the terms and conditions set by El Ramla Hamra.

2.4 These Terms and Conditions form part of all offers and agreements with El Ramla Hamra in so far as they are not expressly provided in writing.

2.5 The terms are accessible to anyone and included on the website of El Ramla Hamra. The terms and conditions can be downloaded from www.elramlahamra.nl. Upon request, we will send you a written copy.

2.6 These terms and conditions also apply to exchanges and markets or any other outlets outside the website.

     

Article 3 Prices and payments

3.1 During the period of offer validity, the prices of the product and / or services offered will not be increased, except price changes due to changes in VAT rates.

3.2 By way of derogation from the previous paragraph, the business owner may offer products or services whose prices are subject to fluctuations in the financial market and where the business owner has no influence on, with variable prices. This range of fluctuations and the fact that any prices quoted are target prices are stated in the offer.

3.3 Price increases within 3 months after the conclusion of the agreement are permitted only if they result from statutory regulations or provisions.

3.4 Price increases from 3 months after the conclusion of the agreement are only allowed if the business owner has stated this and:

A. These are the result of statutory regulations or provisions; or

B. The consumer has the power to cancel the agreement as of the date of the price increase.

3.5 Prices mentioned in the offer of products or services include VAT.

3.6 All prices are subject to printing and printing errors. No liability is accepted for the consequences of pressure and error errors. In case of errors and mistakes, the business owner is not obliged to deliver the product according to the wrong price 

     

Article 4 Offering

4.1 Offers are valid while stocks last.

4.2 The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow a good assessment of the offer by the consumer. When El Ramla Hamra uses images, they are a true and fair depiction of the products and / or services offered. Apparent mistakes or mistakes in the offer do not bind El Ramla Hamra.

4.3 El Ramla Hamra products are imported from Morocco and are made by hand. This means that almost no product is exactly the same. Small irregularities by craft manufacture might be present.

4.4 Each offer contains such information that it is clear to the consumer what the rights and obligations are attached to the acceptance of the offer.

     

Article 5 Delivery

5.1 Orders will be delivered as soon as possible, after receipt of payment and the required information. El Ramla Hamra strives to ship orders within 2 business days, unless explicitly stated otherwise.

5.2 El Ramla Hamra takes the utmost care when accepting orders and shipping the ordered products.

5.3 El Ramla Hamra warrants that the products supplied by it comply with the requirements of usability, reliability and lifespan as reasonably intended by the parties to the purchase agreement.

5.4 Delivery takes place as long as the product is in stock. The products of El Ramla Hamra are imported from Morocco and are made by hand. A delivery time specified by El Ramla Hamra is never to be regarded as a fatal term. The stated delivery time is valid only as an indication.

5.5 El Ramla Hamra uses the current PostNL postal package rates inside the Netherlands and outside the Netherlands. In principle, the shipping is done by PostNL. El Ramla Hamra determines the mode of transport and the carrier

5.6 As a place of delivery, the address you have made known to El Ramla Hamra is valid.

5.7 For orders from € 50, -, no shipping costs are charged within the Netherlands.

5.8 The maximum delivery time is 30 days unless otherwise agreed. If this delivery time is not feasible, we will notify you. If delivery is delayed, or if an order cannot be performed, or only partially, you will receive a notification within one month of placing the order. In that case, you have the right to dissolve the agreement at no cost. You should inform this by email or letter to El Ramla Hamra. All amounts paid will be refunded as soon as possible, but within 30 days of notification. Exceeding the delivery period specified by El Ramla Hamra never gives you the right to compensation.

     

Article 6 – Revocation right

When delivering products:

1. When purchasing products, the consumer has the opportunity to dissolve the agreement without stating a reason for 14 days. This term will expire on the day following receipt of the product by the consumer or an agent appointed by the consumer and notified to the business owner.

2. During the reflection period, the consumer will carefully handle the product and the packaging. He will only extract or use the product to the extent that it is necessary to assess whether he wishes to keep the product. If he makes use of his revocation right, he will return the product with all delivered accessories and - if reasonably possible - in the original condition and packaging to the business owner, in accordance with the reasonable and clear instructions provided by the business owner.

3. When the consumer wishes to withdraw his revocation right, he is obliged to inform El Ramla Hamra within 14 days of receipt of the product. Notifying should be done by e-mail by the consumer. After the consumer has announced that he wishes to revoke his right, the customer must return the product within 14 days. The consumer must prove that the goods delivered have been returned timely, for example by means of proof of shipment.

4. If the customer has not disclosed at the end of the periods mentioned in paragraphs 2 and 3 to use his revocation right or resignation, and the product has not been returned to El Ramla Hamra, the purchase is a fact. 

     

Article 7 - Costs in case of revocation

1. If the consumer makes use of his revocation right, he will be charged with the costs for shipment at the highest.

2. If the consumer has paid an amount, the business owner will repay this amount as soon as possible, but no later than 14 days after revocation. This is subject to the condition that the product has already been received by El Ramla Hamra or closing proof of complete return.
